Terms of Use

1. Acceptance of these terms

These Terms of Use ("Terms") govern your access to and use of tophomematch.com (the "Site"), operated by PingAlpha ("TopHomeMatch," "we," "us," or "our"). By using the Site or submitting a form, you agree to these Terms. If you don't agree, don't use the Site. See also our Privacy Policy, which is incorporated into these Terms by reference.

2. Description of the service

TopHomeMatch is an advertising and lead-generation platform for home service projects (currently solar, roofing, and HVAC). When you submit a project request through the Site, we sell that request to a single third-party lead-buying platform (the "Lead Buyer"). The Lead Buyer operates its own marketplace and decides whether, and how, to route your request to a home service company ("Pro") in its network. TopHomeMatch itself does not perform home services, does not select or vet any Pro, and does not guarantee that any Pro will contact you.

3. Eligibility

You must be at least 18 years old and legally able to enter into these Terms to use the Site. By submitting a form, you represent that you're either the property owner or someone authorized to request services for the property described.

4. We are not a contractor; no guaranteed match, quote, or result

• TopHomeMatch is not a contractor, installer, or home service provider, and does not itself match or connect you to a Pro — the Lead Buyer does that, within its own network, on its own terms.
• We do not guarantee that the Lead Buyer or any Pro will contact you, that a Pro will be available in your area, that any pricing you're eventually quoted will match any estimated range shown on the Site, or that your project will be completed.
• Any pricing ranges, timelines, or savings figures shown on the Site are illustrative only, are not quotes, and are not binding on TopHomeMatch, the Lead Buyer, or any Pro.
• We do not represent that any Lead Buyer or Pro is licensed, bonded, or insured in your jurisdiction. You're responsible for independently verifying a Pro's licensing, insurance, and reputation before hiring them.
• Using the Site is free for homeowners and doesn't create a contract between you and TopHomeMatch for the performance of any home service work.

5. Your responsibilities

You agree to provide accurate, current information when submitting a form, and not to submit a request for a property or project you're not authorized to request services for. You're responsible for any communications you have directly with a Lead Buyer or Pro once they contact you — TopHomeMatch is not a party to that conversation or any resulting agreement.

6. Consent to contact

When you check the consent box on our project request form, you're agreeing to be contacted by TopHomeMatch and the single Lead Buyer your request is sold to, by call, text/SMS, email, or prerecorded/automated message, as described in that form's consent language and in our Privacy Policy. That consent is not required as a condition of any purchase, and you can revoke it at any time using the instructions provided there.

7. Fees

Submitting a project request through the Site is free for homeowners. The Lead Buyer pays TopHomeMatch for the request itself — never for ranking, placement, or endorsement — and that payment doesn't influence which Pro, if any, the Lead Buyer ultimately connects you with.

8. Lead Buyers and Pros are independent, unvetted third parties

The Lead Buyer and any Pro in its network are independent businesses, not TopHomeMatch employees, agents, or partners in a legal sense. We don't vet, rank, verify, or endorse the Lead Buyer's or any Pro's licensing, insurance, work quality, or reputation, and we're not responsible for their conduct, pricing, workmanship, or any agreement you enter into with them.

9. Prohibited uses

You agree not to:

• Submit false, fraudulent, or duplicate project requests, or requests for a property you're not authorized to request services for
• Use the Site to harvest data, scrape content, or attempt to access non-public parts of our systems
• Interfere with the Site's normal operation, including through bots, malware, or excessive automated requests
• Use the Site for any unlawful purpose or in violation of these Terms

10. Intellectual property

The Site, including its design, text, graphics, and underlying code, is owned by TopHomeMatch or its licensors and protected by intellectual property law. You may use the Site for its intended purpose (submitting a project request) but may not copy, modify, or redistribute it without our permission.

11. Disclaimers

THE SITE AND ANY INFORMATION ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY LEAD BUYER OR PRO WILL CONTACT YOU OR PERFORM ANY WORK TO YOUR SATISFACTION.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOPHOMEMATCH AND ITS OFFICERS, EMPLOYEES, AND AGENTS WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SITE OR ANY INTERACTION WITH A LEAD BUYER OR PRO, EVEN IF WE'VE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SITE WON'T EXCEED $100. Some jurisdictions don't allow these limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold TopHomeMatch harmless from any claim or demand, including reasonable attorneys' fees, arising from your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

14. Governing law and disputes

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Arizona, and you consent to personal jurisdiction and venue there.

15. Changes to these terms

We may update these Terms from time to time. We'll update the "Last updated" date above when we do; continuing to use the Site after a change means you accept the updated Terms.
